Super Star Rewards is our customer loyalty program with terms and conditions of use
PART 1 – DEFINITIONS
1. In these Terms, unless the context otherwise requires:
a. Excluded Pharmacy Product means any product that may only be sold by a pharmacy or pharmacist under the laws of the State or Territory where you reside or where the product is delivered. For the avoidance of doubt, this includes medicines listed in Schedule 2 (Pharmacy Medicines), Schedule 3 (Pharmacist Only Medicines), Schedule 4 (Prescription Only Medicines), and Schedule 8 (Controlled Drugs) of the Therapeutic Goods Act 1989 (Cth).
b. Excluded Purchases means purchases of prescription-only medicines, pharmacist-only medicines, dispensary services, Schedule 3 products, gift cards, lottery products, purchases made using gift cards or gift vouchers, delivery charges, cash outs, products or services where Points cannot lawfully be granted, and any other products or services determined by SPG (acting reasonably) from time to time as ineligible for Points.
c. Member means an individual who has registered for and obtained Membership in the Rewards Program.
d. Membership means a Member’s participation in the Rewards Program.
e. Online Store means the online store located at https://www.stardiscountchemist.com.au or https://www.starchemist.com.au as updated from time to time.
f. Points means Super Star Reward Points.
g. Product means products and services made available on the Online Store, including Schedule 2 (Pharmacy Medicines) under the Therapeutic Goods Act 1989 (Cth), but excluding Excluded Pharmacy Products.
h. Rewards Program means the Super Star Rewards Program operated by SPG.
i. Site means the websites and social media platforms operated by Star Pharmacy Group Pty Ltd (ABN 42 480 086 042), including:
i. https://www.stardiscountchemist.com.au;
ii. https://www.starchemist.com.au; and
iii. https://www.starpharmacy.com.au.
j. Seller has the meaning given in clause 27 of these Terms.
k. SPG means Star Pharmacy Group Pty Ltd and/or its partners, associates and related entities operating an SPG Store.
l. SPG Store means any pharmacy listed at https://stardiscountchemist.com.au/all-stores, https://www.starchemist.com.au and/or https://www.starpharmacy.com.au, as updated from time to time, trading as Star Discount Chemist, Star Chemist, or otherwise.
m. SPG Privacy Policy means the privacy policy available at https://www.stardiscountchemist.com.au/privacy-policy.
n. Terms means these terms and conditions, as amended by SPG from time to time.
PART 2 – GENERAL TERMS OF USE OF WEBSITE
SPG operates the Site and the Online Store. By accessing or using the Site or Online Store, you agree to be bound by these Terms.
2.1 Access
2. By accessing and using the Site, you acknowledge and warrant that:
a. You are bound by these Terms;
b. You are over 18 years of age;
c. You will comply with all applicable laws and any additional terms notified on the Site;
d. You will not use the Site for any illegal, fraudulent or unauthorised purpose;
e. You will not interfere with or disrupt the Site or other users’ access; and
f. You will maintain the confidentiality of any login credentials used to access restricted services on the Site.
3. SPG reserves the right, at any time and without notice, to:
a. Modify, vary or discontinue any Product offered on the Site;
b. Temporarily or permanently restrict or disable access to the Site; or
c. Suspend or deny access to any user for breach of these Terms or misuse of the Site.
4. To the maximum extent permitted by law, SPG does not warrant that:
a. Any material or information on the Site is accurate, complete or current;
b. Access to or use of the Site will be uninterrupted, error-free, or free from harmful components;
c. The Site will be free from outages or security breaches; or
d. The Site will be compatible with your device or software.
2.2 Medical Advice Disclaimer
5. The Site may include general information about medical conditions and treatments. This is for general information purposes only and is not a substitute for professional medical advice or for information contained on product packaging or labels.
6. You must not rely on Site content to diagnose, treat or manage any medical condition. Always seek advice from a pharmacist, general practitioner or qualified healthcare professional.
7. While SPG uses reasonable efforts to ensure accuracy, SPG makes no representations or warranties that information on the Site (including Product details) is accurate, complete or current.
8. Your reliance on any information provided on the Site is entirely at your own risk.
2.3 Third Parties
9. The Site may contain links to third-party websites or references to third-party content.
10. SPG does not control and is not responsible for third-party websites or their content. SPG makes no warranties regarding their accuracy, security, or quality.
11. Inclusion of a link or reference does not imply any relationship, endorsement or affiliation by SPG.
12. To the maximum extent permitted by law, SPG is not liable for any loss or damage arising from your use of, or reliance on, any third-party website or content.
2.4 Copyright & Trademarks
13. All material on the Site is owned by SPG or licensed for use from third parties and is protected by copyright, trademark and other intellectual property laws.
14. Nothing in these Terms transfers or licenses any intellectual property rights to you as a user of the Site or Online Store or as a Member of the Rewards Program.
15. You may not copy, modify, use, reproduce or distribute any information found on the Site or Online Store or information published regarding the Reward Program without SPG’s prior written consent.
2.5 Privacy
16. You acknowledge and agree that SPG may collect, hold, use and disclose your personal information as necessary to perform its obligations, in accordance with the SPG Privacy Policy available at https://www.stardiscountchemist.com.au/privacy-policy.
17. You acknowledge and agree to receiving communications (including marketing material) from SPG unless you opt out.
2.6 Social Media Terms of Use
18. SPG welcomes comments on our social media platforms; however, our communications are subject to therapeutic goods advertising legislation. To ensure compliance, please observe the following terms when commenting on or tagging our posts:
a. Do not endorse our products (including by providing testimonials about how the product worked for you) if you are:
i. an employee or contractor of a government, government authority, hospital or healthcare facility;
ii. a current or former health practitioner, health professional or medical researcher;
iii. a person holding out as qualified or trained to diagnose, treat or prevent disease, ailment, defect or injury;
iv. not using your real name; or
v. a person (or a family member of a person) engaged in the production, marketing or supply of the goods.
b. Do not suggest that any government, government authority, hospital or healthcare facility endorses our products.
c. Do not make statements about how a product works for you beyond its approved purpose.
d. Do not provide testimonials about your personal experience if you have received any form of payment, incentive or free product in exchange for your comments.
e. Do not make statements relating to serious conditions, diseases, ailments or defects, including suggestions that a product assisted with the treatment of a serious disease.
19. SPG will disclose paid partnerships, endorsements and any actual or perceived conflicts of interest connected with testimonials published by us on our sites.
2.7 Limitation of Liability
20. The benefit of all exclusions and limitations of liability extends to SPG and all SPG Stores (which may also be a Seller for the purposes of Part 3 of these Terms).
21. To the maximum extent permitted by law, SPG, all SPG Stores and/or the Seller:
a. Exclude all implied warranties in connection with the Products or these Terms;
b. Limit their liability for any loss or damage (including lost or damaged deliveries) to the remedies available under the Australian Consumer Law, being resupply of the Product or a refund, at their election; and
c. Exclude all liability for any indirect or consequential loss (including loss of profit, opportunity or goodwill).
22. To the maximum extent permitted by law, you release SPG, all SPG Stores, the Seller, and their related entities, officers, agents and contractors from all claims arising out of or in connection with the supply of Products under these Terms.
23. No SPG Store has authority to make representations or warranties on behalf of SPG.
2.8 General
24. These Terms are governed by the laws of South Australia and the Commonwealth of Australia. The parties submit to the exclusive jurisdiction of the courts of South Australia.
25. These Terms do not limit any other rights SPG or the Seller may have at law.
26. If any provision is invalid or unenforceable, it will be read down or severed, and the remaining provisions will continue in force.
27. A waiver is only effective if in writing.
PART 3 – ONLINE STORE
SPG operates the Star Discount Chemist Online Store, which is hosted on Shopify Inc. (Shopify). Shopify provides the e-commerce platform that enables us to sell our products and services to you. By accessing, using or purchasing from the Online Store, you agree to be bound by these Terms.
3.1 Products
28. The Online Store sells Products only. If you wish to purchase an Excluded Pharmacy Product, please visit your nearest SPG Store.
29. When you place an order via the Online Store, the Seller of the Product will be:
a. For Click & Collect Orders – the SPG Store you nominate as the pick-up location;
b. For standard delivery orders within Queensland – Gardiakos Pharmacy Pty Ltd ATF Gardiakos Pharmacy Trust and GetWell Soon Co. Pty Ltd ATF The Hassan Trust, trading as Star Discount Chemist Narangba (PBS No. 34873K); and
c. For standard delivery orders in all other States – Kilkenny CK Pharmacy No. 1 Pty Ltd ATF Kilkenny CK Pharmacy No. 1 Trust and Kilkenny CK Pharmacy No. 2 Pty Ltd ATF Kilkenny CK Pharmacy No. 2 Trust, trading as Star Discount Chemist Kilkenny (PBS No. 41471Q).
30. SPG reserves the right, at any time and without notice, to:
a. Amend advertised prices for Products;
b. Vary or withdraw advertised discounts or savings;
c. Modify, suspend or discontinue the supply of Products; or
d. Impose purchase quantity limits.
31. SPG and the Seller are not liable for any modification, price change, suspension, or discontinuance of any Product.
32. Product availability may differ between the Online Store and SPG Stores. Some Products may be available exclusively online.
33. Certain Products may have inherent characteristics (for example, natural variations in weight or minor packaging differences) beyond our reasonable control. SPG accepts no liability for such variations.
3.2 Ordering
34. By placing an order through the Online Store:
a. You make an offer to purchase the Product from the Seller in accordance with these Terms and any additional terms displayed at checkout; and
b. You consent to receive communications from SPG or the Seller (including by email or SMS) regarding your order.
35. Once your order is accepted, you will receive an order confirmation at your nominated email address.
36. The Seller may, in its discretion:
a. Reject your order (for example, if a Product is unavailable or a pricing or description error occurred); or
b. Limit the quantity of Products purchased.
If this occurs, you will be notified using the contact details provided and refunded any amounts paid. Refunds will be processed to your original payment method within a reasonable time.
3.3 Payment
37. The Online Store accepts major credit cards (Visa, Mastercard) and payment platforms including PayPal and Afterpay. Your nominated payment method will be charged at the time your order is placed.
38. You must provide accurate billing and contact details to enable order processing and communication.
39. SPG may act as the Seller’s agent to accept and process your order, including the receipt of payment.
3.4 Delivery
40. Deliveries are fulfilled by third-party contractors. Additional delivery information is available at https://support.stardiscountchemist.com.au/knowledge/online-delivery.
41. No guarantees are provided in relation to delivery times.
42. SPG and the Seller are not liable for any delay or failure in delivery arising from a Force Majeure Event (being any event beyond their reasonable control).
3.5 Returns & Exchanges
43. In addition to your rights under the Australian Consumer Law, returns and exchanges for Products purchased via the Online Store are governed by our Refund Policy, available at: https://support.stardiscountchemist.com.au/knowledge/refunds-and-returns.
3.6 Catalogue Specials
44. Catalogue Product availability may vary between the Online Store and SPG Stores.
45. Catalogue Products are available only while stocks last and quantity restrictions may apply.
46. Unless otherwise stated, savings are based on the Recommended Retail Price (RRP), which may not reflect SPG’s usual selling price.
47. Free gifts are available only while stocks last.
48. SPG reserves the right to correct any errors (including description or pricing) relating to Catalogue Products.
PART 4 – SUPER STAR REWARD PROGRAM
SPG operates the Rewards Program with its franchise partners who operate SPG Stores. By applying to become a Member, you agree to be bound by these Terms.
4.1 Application for Membership
49. Individuals may apply for Membership at any SPG Store or on the Site.
50. Membership is open only to natural persons aged 18 years or over with a current Australian residential address.
51. A Member may hold only one Membership at any given time.
52. Membership and its benefits:
a. Are offered at SPG’s sole discretion; and
b. Are not transferable.
4.2 Earning Super Star Reward Points
53. Subject to these Terms, Members will earn three (3) Points for every whole dollar spent at an SPG Store.
54. Points will not accrue on:
a. Excluded Purchases;
b. Transactions involving redemption or use of Points;
c. Payments made by or on behalf of third parties; or
d. Historical transactions where Membership details were not provided at the time of purchase.
55. To earn Points, Members must either:
a. Present their Membership card (including digital or virtual cards) at the time of purchase; or
b. Provide sufficient details to enable SPG staff to locate their Membership record.
56. There is no limit to the number of Points a Member may earn.
57. Members will receive 500 Points upon activation of their Membership (equivalent to $5 to spend in-store or online).
4.3 Redeeming Points
58. Points may be redeemed for full or partial payment at participating SPG Stores, at the rate and in the manner published by SPG from time to time.
59. To redeem Points, Members must scan their Membership card at the time of purchase.
60. SPG may require proof of identity before processing a redemption.
61. Points are personal to the Member and cannot be assigned, transferred or shared. SPG is not responsible for unauthorised use or redemption of Points.
62. Points cannot be exchanged for cash, vouchers or credit notes.
63. Points cannot be combined between Memberships.
64. Points are valid for 365 days from the date they are earned and automatically expire thereafter.
4.4 Deduction or Cancellation of Points
65. SPG may deduct or cancel Points if it determines, in its sole discretion, that the Points were:
a. Earned in error;
b. Associated with a cancelled, refunded or reversed transaction; or
c. Obtained through dishonesty, misrepresentation or fraud.
4.5 Amendment of Redemption Arrangements or Terms
66. SPG may amend the Rewards Program, Redemption Arrangements or these Terms. Where a change affects the value of Points already earned, SPG will provide at least three (3) months’ notice before implementation.
67. Notice of amendments will be published on SPG’s website or communicated by other reasonable means (including email).
4.6 Privacy
68. By registering for Membership, you consent to:
a. SPG collecting, holding, using and disclosing your personal information in accordance with the SPG Privacy Policy; and
b. Receiving marketing communications from SPG unless you opt out.
4.7 Updating Membership Details
69. Members are responsible for maintaining the accuracy and confidentiality of their Membership details.
70. Requests to update Membership information may be sent to SPG’s Privacy Officer at privacy@starpharmacy.com.au
4.8 Termination
71. A Member may terminate their Membership at any time by written notice to:

72. Membership will automatically terminate upon the Member’s death.
73. SPG may immediately terminate a Membership if a Member:
a. Provides false or misleading information; or
b. Engages in dishonest, fraudulent or unlawful conduct.
74. SPG may terminate a Membership without cause by providing three (3) months’ notice.
75. SPG may discontinue the Rewards Program by providing six (6) months’ notice.
4.9 Consequence of Termination
76. Upon termination of Membership for any reason, all accrued Points will immediately expire and become void.
4.10 Intellectual Property
77. All elements of the Rewards Program are protected by trademarks, copyright and other intellectual property rights owned by SPG or third parties.
78. Nothing in these Terms transfers or licenses any intellectual property rights to Members.
79. Members must not use any trademark without the owner’s prior written consent.
80. All rights (including copyright and moral rights) in the Rewards Program and its materials are reserved by SPG. Members must not:
a. Copy, reproduce, distribute or transmit any part of the Rewards Program, except as expressly permitted; or
b. Reuse or republish any content without SPG’s prior written consent.
